Altantuya case: DPM Najib seen with Altantuya

Najib was seen having a meal together with Altantuya in a photograph according to Mongolian witness Amy ( Burmaa Oyunchimeg). What did he say during the Ijok by-election? Didn’t he say that he has never met her? We are very proud of Karpal Singh because for his timely intervention. If not for him, we will be still in the dark about the rendezvous btween Najib and Altantuya. At the same time , we were very upset with Manoj and Tun Majid who deliberately avoided the probing. Both must be punished for this act.Najib must now explain what sort of relationship he has with Altantuya(a.k.s Amina). Both Shariibuu family and Malaysians have a right to know.

A Mongolian witness caused a stir in court today when she revealed that murdered Mongolian national Altantuya Shaariibuu had been photographed having a meal with a Malaysian government official named Najib Razak.Burmaa Oyunchimeg (left), also known as Amy, told the Shah Alam High Court that Altantuya had shown her the photo in Hong Kong when she returned from a trip to France.It is believed that the government official in the photograph is Deputy Prime Minister Najib Abdul Razak, who has close ties with political analyst Abdul Razak Baginda.The latter has been charged with abetting the murder of Altantuya, 28.Najib has previously denied that he had personally met the murdered woman and that he heard of her only from newspaper reports after Altantuya was murdered.This morning, Burmaa, 26, had mentioned the photograph when re-examined by DPP Manoj Kurup.Manoj was asking whether she had personal knowledge of Altantuya’s disappearance.Burmaa began her answer conveyed by her translator Enkhjargal Tsetsgee that she knew Altantuya had come to see Razak who happens to be the only person she knows in Malaysia.

“I know why she wanted to see Razak Baginda, I have seen pictures of Altantuya with Razak and a government official,” she said.

However, Manoj quizzed her as to how she knew Altantuya disappeared and did not follow up with Burmaa’s sudden revelation.

About 20 minutes later, lawyer Karpal Singh, who is holding a watching brief for the deceased’s family, sought permission from the court to pose a question on the photograph.

‘They had the same name’

This drew protests from the prosecution and a verbal exchange ensued on the relevance of the question. However, judge Mohd Zaki Mohd Yasin granted Karpal permission.

The veteran lawyer then proceeded to ask Burmaa on what was depicted in the photograph.

“She (Altantuya) was having a meal at a round table with Razak (Baginda), a Malaysian government official and other people,” she replied.

Karpal then asked her on the identity of the government official, and she replied: “I remember the name Najib Razak, they had the same name, ‘Razak’. I thought they were brothers. I asked her (Altantuya) if they were brothers.”

This sparked off another exchange between the prosecution and Karpal before the judge dismissed Burmaa and directed the courtroom to stand down for 15 minutes.

The next witness was lance corporal Rohaniza Roslan, 29, who had testified that the red Proton Wira aeroback – which was seen by Razak’s private investigator P Balasubramaniam as the car that took Altantuya away on Oct 19 last year – belonged to her.

Examined by DPP Noorin Badaruddin, Rohaniza said she was off duty that night and was keeping Azilah company at the police headquarters in Bukit Aman.

She and Azilah were a couple at that time.

“Azilah had an assignment to escort the PM and DPM to Hong Kong but it was cancelled. So I was there to help him unpack his belongings,” she said.

Rohaniza elaborated that Azilah received a call and later followed him to Bukit Damansara. She said she saw an Indian man talking to a “Chinese woman”.

She told the court that she then moved to the back seat and the Chinese woman sat next to her.

‘Don’t create trouble’ 

According to Rohaniza, a man in a green cap then showed up, entered the car and Azilah drove them away before dropping the man off at a junction nearby.

“He got out of my car, went into a green (Suzuki) Vitara and Azilah tailed him to a highway towards the direction of Bukit Aman.

“It was then the Chinese woman asked us who we were and Azilah told her “police”,” the Petaling Jaya-based officer told Noorin.

She said Azilah told the Chinese woman not to create trouble at Razak’s house because he has a family at home and that she should find Razak at his office instead.

Rohaniza who was tearing when she was asked to point Azilah out as she revealed that she has known Azilah since 1998 when she joined the police force.

Two police officers – Azilah, 30, and corporal Sirul Azhar Umar, 35 – are charged with the murder of Altantuya. Razak, 47, is charged with abetting them.

Prosecutors allege that Abdul Razak and Altantuya met in 2004 and began a whirlwind affair, during which he gave her money.

After they broke up a year later, he allegedly continued to give her money whenever she demanded. But the payments stopped last year, prompting her to become dissatisfied and travel to Malaysia in October, the prosecution said.

Altantuya was killed by ‘probable blast-related’ injuries in a clearing in Shah Alam after she was driven away from outside Abdul Razak’s house in mid-October.

All three accused faced the death penalty.

【本刊曾薛霏撰述】副首相纳吉名字在沙亚南法院中响起!“炸尸案”死者阿尔丹杜雅(Altantuya Shaariibuu)的堂妹布尔玛(Burmaa Oyunchimeg)今日继续供证,阿尔丹杜雅曾向她出示一张照片,图片中的人包括阿尔丹杜雅、第三被告拉萨巴金德和一个政府高官。她稍后向法庭表示,照片中的政府高官是纳吉拉萨(Najib Razak)。此惊人揭露让“炸尸案”审讯案透出其“政治”气息,主控官阿都马吉(Abdul Majid Tun Hamzah)却指照片与案情无关,与辩护律师一起反对卡巴星盘问证人。

布尔玛(右图)今日接受主控官马诺(Manoj Kurup)盘问时,答非所问,忽然爆出她知道阿尔丹杜雅来马的原因,是要找第三被告阿都拉萨,因为阿尔丹杜雅并没有认识其他马来西亚人。而且更指她曾看过一张阿尔丹杜雅的照片,照片中有阿尔丹杜雅、阿都拉萨和政府高官。

当布尔玛供证到这里时,遭到主控官马诺打断。主控官认为布尔玛没有回答他的问题,打断她的回答,然后继续发问其他问题。

布尔玛也强调,在2005年8月时,阿尔丹杜雅和阿都拉萨的关系还存在,因为她知道两人曾结伴一同去欧洲的法国和意大利旅行。根据主控官开庭陈词,阿尔丹杜雅和阿都拉萨是在2004年认识,不过两人在2005年8月已经分手。

阿都马吉与卡巴星争论

当旁听律师卡巴星要透过法庭盘问证人有关照片一事时,主控官阿都马吉起来反对,理由是:“此事与案情无关”(Irrelevant)。

法官和主控官同时表示他们并没有抄到这一段。而证人这时也举手告诉法庭她确实说过有关照片的事情。再度获得第一被告辩护律师和主控官的强烈反对。尔后,法官准许卡巴星通过法庭盘问证人。

阿尔丹杜雅从法国回来后,直接去香港探望她时,向她出示在欧洲旅游的照片,其中一张照片是一个圆桌的聚餐会,图中有阿尔丹杜雅、阿都拉萨、一名政府高官和其他人。家属旁听律师卡巴星(Karpal Singh)透过法院盘问布尔玛:“你是否知道这名政府高官?”

这时,主控官阿都马吉(右图)再度站起来,指“此事与案情无关”Irrelevant)。

卡巴星表示,在第三被告的宣誓供诉书中指出,副首相的首席保镖下令随从带走死者。

法官随后询问卡巴星当家属旁听律师的目的是不是为了政治目的,卡巴星回答说,我们要确保审讯没有任何隐瞒。他身为家属旁听律师,就必须确保真相大白。辩护律师指卡巴星指导证人供证

第一被告辩护律师不满意卡巴星作出这样的指控,并表示如果卡巴星可以这样断言,他也可以断言卡巴星指导证人供证(coaching the witness)。卡巴星随后要哈兹曼收回这个说法。不过哈兹曼坚持不肯。

阿都马吉表示:“我们不是来这里把法庭变成一个政治论坛。这里是法庭,你可以去国会做这些事情,但你必须尊重法庭,检察署会确保每个人获得公平的审讯。我们的工作是要真相大白。”

过后,法官不允许卡巴星继续盘问证人。他也表示不会针对卡巴星和哈兹曼的主张下命令。不过,会把照片的供词记录在案。布尔玛曾在去年10月21日发出手机短讯给控方第一证人巴拉苏巴马廉(Balasubramaniam),她也在昨天承认是一则恐吓短讯,但今天在庭上,她否认了昨天承认恐吓巴拉的供词,并指她其实不明白第三被告辩护律师王健强的问题。【点击:死者堂妹承认发短讯恐吓巴拉 四恐吓字条乃阿尔丹杜雅笔迹】

她供证时表示,自己是在极度生气的情况下发出这则短讯,因为她很担心堂姐阿尔丹杜雅的安危,而当她致电给巴拉时,巴拉只说阿尔丹杜雅乘搭德士走了,当她欲进一步发问时,巴拉就终止了两人的谈话。

布尔玛今天正式供证完毕。她在步出法庭时,对媒体发言表示自己会就哈兹曼指卡巴星指导她供证的指控,报警。

纳吉:我不认识阿尔丹杜雅

在今年四月雪兰莪依约区(Ijok)州议席补选期间,前副首相安华依布拉欣在“炸尸案”课题上向与三名被告都有关的纳吉左右开弓,并在4月21日一场政治演说中公开质问纳吉是否认识阿尔丹杜雅。

在另一厢,替国阵候选人竞选拉票的纳吉(左图)则回应,指自己根本就不认识阿尔旦杜雅,也从来没有见过阿尔旦杜雅,而他也和其他人民一样,在发生炸尸案后,才第一次在报章上看到阿尔旦杜雅的照片。【点击《中国报》:纳吉:“我根本不认识她” 警方调查证明无关】 

本案件自开审以来,审讯、媒体报道皆以“桃色情杀案”为导向。然而,早前向高等法院申请退出为“炸尸案”首被告抗辩的律师朱基菲里诺丁(Zulkifli Nordin),曾向《国际先驱论坛报》透露,辨方有意传召副首相兼国防部长纳吉出庭供证,交代他和首被告、首席警长阿兹拉哈德里(Azilah Hadri)会面的事。

此外,朱基菲里(右图)原本也要在法院揭露“炸尸案”死者阿尔丹杜雅莎莉布在2002年的一宗法国潜水艇采购案里扮演的角色。

Murdered Mongolian national Altantunya Shaariibuu had written an ominous letter before her death that she believed her ex-lover, political analyst Abdul Razak Baginda, wanted to kill her.The undated letter, written before she disappeared, was addressed to the ‘Malaysian government or police or Embassy of Mongolia or newspapers’. The letter, which was revealed by the prosecution team, took the packed courtroom by surprise and was read out by the deceased’s cousin Burmaa Oyunchimeg in the Shah Alam High Court today.

Burmaa, 26, who is also known as Amy, said she found the two-page letter in a white Guess bag among other belongings left behind by Altantuntya in the hotel on Nov 20.

In the hand-written letter bearing Hotel Malaya’s letterhead, Altantunya said in poor English that she was going to commit suicide before Razak’s private investigator P Balasubramaniam and his assistant K Suras Kumar get to her.

Earlier in the trial, the murdered woman’s two Mongolian companions – Namiraa Gerelmaa and Uuriintuya Gal Ochir – had testified that Balasubramaniam and Suras had threatened to kill them and throw them ‘out of the window’.

“And before I write (this) letter I’ll (kill) myself, because I have no choice, he (Altantuya’s PI Ang Chong Beng) told (me) that they (Bala and Suras) have my letters so they kill me and say (it was) suicide,” she wrote.

In the letter, she had expressed her fear over the threats from the duo and described how they have been harassing her at 5am in Hotel Malaya where she was staying.

“They have been following me for four to five days. Even my hotel where I staying, workers know.” 

She wrote that Razak had allegedly promised to help her when she was in Mongolia and that was why she came looking for him.

She called him her boyfriend but Ang testified yesterday that she said they were married.

In the letter, Altantunya also conceded it could have been a mistake to ‘blackmail’ the analyst and wrote, “Maybe I (was wrong) to have bothered and blackmailed him.

“But if he didn’t promise me, I would (have) never come from far away to Malaysia,” she wrote in black ink.

Altantuya disclosed that she did ask Razak for money but she had her own reasons.

“Mr Razak Baginda promise to help me when I was in Mongolia. That’s why I came to see him and for help but he trying to kill me.

“I’m nice person. I can’t hurt someone but (Razak) is a powerful person, he (has) money (and) he (has) connection (to the) police (and the) government,” she stated.

Altantuya also revealed that she had gone to his residence in Bukit Damansara, Kuala Lumpur, on several occasions and knew that he was married and had a daughter named Rowena.

Like a couple

Earlier on, Burmaa told the court that she had met Razak on three occasions since 2004 in Hong Kong, Shanghai and Singapore.

“Altantunya was always there with him,” she answered in Mongolian and translated through by her interpreter, Enkhjargal Tsetsgee.

Asked by DPP Manoj Kurup to describe how they looked when they were together, Burma said: “They looked like boyfriend and girlfriend.”

Burmaa (right), who studied English in Hong Kong, told the court that Altantuya would visit her and they had a very close relationship.

She said that Razak would contact her mobile phone to speak to Altantuya when she was in Hong Kong. 

Burmaa also revealed that she had received a text message from Razak last year saying: “Amy, can you let Altantuya know I don’t want to see her again.”

“I told Altantuya about it but she said there was a little misunderstanding and told me that she would go to Malaysia, meet Razak and sort it out,” Burmaa said.

The management graduate said she knew Razak had sent Altantuya money because she was asked to relay information of the transfer of some money through an agency by the former to the latter.

“He told me ‘the reason I called you is because I’ve transferred money to Altantuya by Western Union. I have a reference number so I’ll let you know and you can tell her’,” she testified.

Manoj then proceeded to cross-examine Burmaa about the letter and said there were another two documents allegedly bearing Altantuya’s signature for her to identify.

Judge Mohd Zaki Md Yasin then broke the session for lunch and told Manoj to resume his questioning at 2.15pm.

Razak has been charged with abetting the murder of the 28-year-old Mongolian national.

Two police officers – chief inspector Azilah Hadri, 30, and corporal Sirul Azhar Umar, 35 – are charged with the murder.

Prosecutors say Abdul Razak planned her killing and ordered two police officers — members of a special unit charged with protecting the country’s leaders – to carry it out.

Altantuya was killed by “probable blast-related” injuries in a clearing in Shah Alam after she was driven away from outside Abdul Razak’s house in mid-October. 

Abdul Razak is close to Deputy Prime Minister Najib Razak, who has vehemently denied any involvement in the case, which is seen by observers as a test of Malaysia’s judicial and political integrity.

【本刊曾薛霏撰述】雪兰莪莎亚南高等法院今天传召“炸尸案”死者阿尔丹杜雅的堂妹布尔玛(Burmaa Oyunchimeg,别名艾美Amy)供证,她说在阿尔丹杜雅遗留的手提袋里找到一封信,阿尔丹杜雅在信里提到,第三被告阿都拉萨试图杀害他,且派了两个印度人跟踪了她四、五天。

 

这封手写的自白书,写在马来亚酒店的信头纸上;布尔玛(右图)供证时说,她认出那是阿尔丹杜雅的笔迹。阿尔丹杜雅在吉隆坡逗留期间,下榻于茨厂街的马来亚酒店。这封信已列为呈堂证物。“炸尸案”第三被告阿都拉萨巴金德(Abdul Razak Baginda)是副首相兼国防部长纳吉的幕僚。控方以刑事法典第109条款提控阿都拉萨唆使谋杀罪,并与刑事法典第302条款(谋杀罪)同读;若被判罪名成立,唯一刑罚是死刑。

“致所有马来西亚政府或警察或蒙古大使馆,或报纸:

 

我的名字是阿尔丹杜雅,我来马来西亚见我的男友阿都拉萨巴金德,他已婚且和女儿萝薇娜(Roweena)、妻子玛兹丽娜(Mazlina Makhzan)和父母住在白沙罗高原(Damansara Heights)。他的办公室在安邦路(Jalan Ampang)。是的,我曾到他的家和办公室找他,因为我得见他。是的,我向他要钱,但这有原因。我是好人,我不会伤害任何人,但是阿都拉萨是个有权有势的人,他和警方及政府有联系。

 

“如果我要,我已经弄死你”

 

“他试图恐吓我,试图杀我。他派了两个印度人跟踪我,其中一个是苏拉斯(Suras Kumar),他每天早上大约五时左右便来我住的酒店客房敲门,企图恐吓我。另外一个保镖则对我说:如果我要,我已经弄死你了。

 

他们跟踪了四、五天,就连我住的酒店的员工都知道。当时我真的很害怕,我现在碰到一些问题了。我还在蒙古时,阿都拉萨答应要帮我,这就是为什么我来向他求助。

 

但是他企图杀我,而那两个印度人告诉我,他们和警察有来往,因此他们能把我关进监牢。是的,或许我错误的干扰他和勒索他,但是如果他没有答应帮我,我不会老远来到马来西亚。我来这里的唯一原因,是向阿都拉萨求助。

 

我请了一个私家侦探,但是他今天告诉我,那两个印度人会杀我,把我抛出窗外。在我写这封信之后,我会自杀,因为别无选择。他告诉我,他们有我的信,他们可以杀掉我,再说是我自杀。”

 

男女朋友的关系

 

布尔玛是阿尔丹杜雅的堂妹,两人关系很好。布尔玛是在去年1120日晚上九或十时左右,在阿尔丹杜雅的手提袋发现这封信。

 

布尔玛说,她是经阿尔丹杜雅介绍认识阿都拉萨,且见过阿都拉萨三次。第一次是在200411月底或12月初,在香港的一间酒店,阿尔丹杜雅介绍她认识阿都拉萨。第二次是20051月,在上海见面,当时她陪阿尔丹杜雅去上海见阿都拉萨。第三次200538日,在新加坡,当时阿尔丹杜雅与阿都拉萨都已抵达,她过去和他们会合。

 

主控官问布尔玛,如何形容阿尔丹杜雅和阿都拉萨的关系;布尔玛回答:男女朋友的关系。

 

布尔玛说,阿尔丹杜雅去香港探访她时,阿都拉萨会拨她的手机与阿尔丹杜雅联络。阿都拉萨有布尔玛在香港的联络号码。

 

阿都拉萨曾汇款给阿尔丹杜雅

 

布尔玛说,去年初,她的手机遗失了,但手机遗失前,她曾接到阿都拉萨(右图)的电话;阿都拉萨告诉她,他联络不上在蒙古的阿尔丹杜雅,请她转告阿尔丹杜雅,他已透过Western Union 汇了一笔钱给阿尔丹杜雅。

 

阿都拉萨也要布尔玛将汇款的参照号码转告阿尔丹杜雅,布尔玛后来口讯转告了阿尔丹杜雅;至于阿都拉萨汇了多少钱,布尔玛说她已不记得了。

 

去年八月,阿尔丹杜雅去香港探望布尔玛;在这之前,布尔玛收到阿都拉萨的短讯,短讯内容是:“Amy,你能不能告诉阿尔丹杜雅,我不想再见到她。”布尔玛把短讯内容转告了阿尔丹杜雅,阿尔丹杜雅说他们之间有小误会,她会去吉隆坡解决这件事。

 

布尔玛说,这是她最后一次见到阿尔丹杜雅。阿尔丹杜雅生前雇用的私家侦探洪忠炳(音译)昨天供证时,否认曾和阿尔丹杜雅、纳美拉(Namiraa Gerelmaa)及乌琳杜雅(Uurintuya  Gal-Orchi)同谋,勒索阿都拉萨;他也否认曾在去年10月17日向后者发送手机留言勒索。【点击:辩方质疑与死者合谋勒索 侦探否认向阿都拉萨开价】

‘Razak’s team proud of my daughter’s murder’

The family and friends of murdered Mongolian national Altantunya Shaariibuu gathered outside the Shah Alam High Court this morning with posters calling for justice.The four also chanted ‘Altantunya’ and ‘Mongolia’.The deceased’s father Shaariibuu Setev (right) held a poster which read ‘Malaysia! Baginda’s team is proud of my daughter’s murder’.

Altantunya’s cousin Uuriintuya Gal Ochir displayed a poster which read ‘Hope justice will be done by the Malaysian court’.

Two other posters held up by the deceased’s friend Burmaa Oyunchime and her cousin Namiraa Gerelmaa denounced Abdul Razak Baginda, among others, saying ‘he has no place on earth’ and that ‘he is not a human being’.

The four stood outside the building for several minutes before dispersing. Today is the ninth day of the high-profile murder trial.

Death penalty

Razak, a renowned political analyst, has been charged with abetting the murder of the Mongolian national.

Two police officers, Chief Inspector Azilah Hadri, 30, and Corporal Sirul Azhar Umar, 35, are charged with the murder which allegedly took place between 10pm on Oct 19 and 1am on Oct 20 last year.

Mongolian translator Altantuya, 28, was said to be blown up in a jungle clearing in Shah Alam, Selangor.

All three accused face the death penalty if convicted.

On Tuesday, Razak’s staff showed up at court with a banner expressing support for their boss. The banner read ‘Razak Baginda staff. And we’re with you. Proud of it.’

On the first day, his relatives wore T-shirts declaring their relationship with him on the front, and stating “and proud of it” at the back.

Altantuya case: Altantuya married Razak?

Razak has denied that he has not married with Altantuya in Hong Kong. So what kind of relationship between Razak and her then? And how many bloggers believe in Razak’s story?

Many Malaysians felt cheated by the Eric Chia’s case. We want justice to be done and also seen to be done in this Altantuya’s case.

The private investigator hired by Mongolian national Altantuya Shaariibuu told the Shah Alam High Court today that she had married political analyst Abdul Razak Baginda two years ago in Hong Kong. Ang Chong Beng (photo), 56, who began testifying yesterday said he was hired by Altantuya, 28, last September to find out whether Razak was still in the country.

She had claimed that Razak, at that time, was her husband of two years.

Cross-examined by Razak’s counsel Wong Kian Kheong, Ang said the information was related to him by Altantuya herself and that he did not suspect anything was amiss.

“I did not ask for proof whether she was married or not because I had no right to,” he told Wong through a translator.

When asked whether Altantuya had produced any marriage documents, Ang replied, “No, she just said so,” adding that he never suspected she was lying.

“I agree that I took her bare assertion at face value despite being a private investigator of 22 years.”

Ang revealed that Altantuya had called him at around 6pm on Oct 19 and asked him to take her to Razak’s house in Bukit Damansara.

“She told me that (Razak’s private investigator P) Balasubramaniam had called her and told her to go to Razak’s house. I told her that I was in Johor and I didn’t have time. I told her to take a taxi (to Razak’s place),” he said.

According to previous witnesses, Altantuya was last seen on Oct 19 outside Razak’s house. She arrived in a taxi but was allegedly taken away by chief inspector Azilah Hadri in a red Proton Wira.

‘No share of money’

Wong also probed the private investigator about the night Altantuya went to the Brickfields police station to lodge a police report.

Wong: Did you suspect that the Mongolian women – who visited Razak at his office several times but consistently failed to see him – could be harassing Razak? Did it cross your mind?

Ang: Yes.

Wong: Did you know you and Altantuya went uninvited to Razak’s house at 11pm on Oct 17 last year?

Ang: Yes.

Wong: Did you know Razak’s house was private property?

Ang: Yes.

Wong: In your experience as a PI of 22 years, what offence could Razak have committed if he had uninvited visitors to his private property at 11pm?

Ang: I don’t know.

Wong: Would you agree that Razak in these circumstances have done nothing wrong and Altantuya had no basis to lodge a police repot against him that night.

Ang: Yes

Ang, who said he was paid US$600 (RM2,090) by Altantuya in Oct 1 last year, denied that he was promised a share of the US$500,000 (RM1.74 million) that she was said to have demanded from Razak.

He said he did not know whether Razak and Altantuya were Muslim or whether Razak was married.

Wong also asked if Altantuya had told Ang what she would do if Razak did not pay her the US$500,000.

Ang answered: “Yes, she said if Razak does not pay her, she would reveal everything (about her relationship with Razak) to his wife, his daughter Rowena, TV3, reporters and to the rest of the world.”

Words ‘were mine’

Earlier today, Ang admitted that he had written the missing person’s report that was lodged at the Jalan Tun HS Lee police station in the morning by Altantuya’s cousin Namiraa Gerelmaa after Altantuya’s disappearance.

“Yes, all the words were mine from the first to the last sentence. Actually, I wanted to make a police report myself because Altantuya was my client,” he told deputy public prosecutor Manoj Kurup.

“I let Namiraa do it (make the report) because I thought she is closer to Altantuya. Namiraa could not speak proper English and could only say ‘Altantuya no come back’.”

Ang, who has avoided being photographed by shielding the lower half his face with a brown envelope, had been answering questions in court with a blue subpoena document and Mykad over his face since yesterday.

Meanwhile, Razak told reporters from the dock that he would direct his lawyers to check with the Hong Kong marriage registrar for proof of his purported marriage to Altantuya as far back as September 2004.

“I am 100 percent sure that she (Altantuya) is lying,” he said before being taken away during the lunch break.

The hearing resumed shortly after 2.15pm.

Father queries Altantuya’s missing entry records

The father of a murdered Mongolian woman wants police to investigate why the immigration records of her and two companions allegedly disappeared.

Karpal Singh said the father of Altantuya Shaariibuu, 28, would file a police report after the allegations emerged during court testimony on Tuesday at the trial of Abdul Razak Baginda, 47, a political analyst charged with abetting Altantuya’s murder in October last year.

Prosecutors say Abdul Razak planned his former lover’s killing and ordered two police officers – members of a special unit charged with protecting the country’s leaders – to carry it out.

All three face the death penalty if found guilty.

“It is a very pertinent and significant issue because if any attempt was made to show that Altantuya never entered the country and therefore could not have been murdered, then I think the police ought to investigate why,” Karpal told reporters outside court.

‘Our entry was deleted’

Uuriintuya Gal-Ochir, 30, a friend of Altantuya, has testified she came to Malaysia with her in October, along with Namiraa Gerelmaa, Altantuya’s second cousin.

Uuriintuya testified that Namiraa returned home earlier without a problem but when she tried to leave Malaysia with Altantuya’s father on Nov 24 – more than a month after the murder – there was no record of their entering the country.

“Our entry was deleted in the immigration computer,” she testified.

The woman banged the witness stand and added: “There is no record of me coming to Malaysia through Beijing. Why?”

“I think it’s a very serious matter that an attempt was made to obliterate the names of the two witnesses and Altantuya,” Karpal told reporters today.

Abdul Razak is close to Deputy Prime Minister Najib Razak, who has vehemently denied any involvement in the case, seen by observers as a test of the country’s judicial and political integrity.

A Mongolian witness told the Shah Alam High Court today that political analyst Abdul Razak Baginda had threatened to kill her, Altantuya Shaariibuu and another friend.Namiraa Gerelmaa, 23, said following this threat, Altantuya and their friend Uuriintuya Gal Orchir had lodged a police report on the afternoon of Oct 19, 2006.She said the threatening message was related to them by Abdul Razak’s private investigator P Balasubramaniam and his assistant K Suras Kumar.“Suras Kumar and Balasubramaniam threatened to kill us, to throw us out of the window. Every night, around 3am to 5am, Suras came to the hotel (Malaya) and forcefully knocked on the door to enter our room,” she said during the examination-in-chief by Deputy Public Prosecutor Manoj Kurup.She also said that she knew Altantuya had been under a lot of pressure “thinking that she is under threat that she would be killed.”

Namiraa also revealed that Suras had entered the room which Namiraa, Altantuya and Uuriintuya shared several times.

“One morning at 5am, Suras knocked on the door forcefully and he came into the room. He then slept in one of our beds until 10am.

“We were so scared that we didn’t sleep and stood in our room the whole time,” she said via Mongolian interpreter Engkhjargal Tsetsgee.

Manoj then asked if Suras was ever friendly to any one of them and she replied with a stern ‘No’.

“Every time he came (to see us), he said ‘Razak Baginda sent me to kill you’. That is why it has been unpleasant,” she explained.

‘Visit her boyfriend’

During cross examination Abdul Razak’s counsel Wong Kiang Kheong asked Namiraa why did Altantuya continue to look for his client at his house despite the harassment from Suras and Balasubramaniam and lodging a police report against them.

“I don’t know,” she answered but said she was worried when Altantuya decided to go to Abdul Razak’s house alone on the night of Oct 19.

Wong also quizzed Namiraa about her flight tickets which she answered that all three of them had purchased their return air tickets before entering Malaysia as tourists.

“I came to visit Malaysia and to find out about studying a language course. My mother paid for my ticket,” she pointed out.

Asked to relate her conversation with Altantunya before leaving Mongolia, she said: “Altantuya told me that she was coming (to Malaysia) to visit her boyfriend but never told me his name. I also did not ask for it.”

Namiraa also said that she did not know about Altantuya demanding US$500,000 and three air tickets to Mongolia from Abdul Razak.

Last Tuesday, first prosecution witness Balasubramaniam told the court that Altantuya had made those demands from Abdul Razak two days before she was murdered

Today was Namiraa’s second day to be called to the witness stand. She was first called to the stand last Friday.

The courtroom remained packed on the sixth day of the trial.

Accused Abdul Razak appeared cheerful and sported a new cropped hair-do. He was seen using an electric shaver before the hearing started at 9:30am when judge Mohd Zaki Md Yasin entered.

Chief Inspector Azilah Hadri, 30, and Corporal Sirul Azhar Umar, 35, from the police Special Action Squad are charged with murdering translator Altantuya, 28, at a location between lots 12843 and 16735, Mukim Bukit Raja, here between 10pm on Oct 19 and 1am on Oct 20 last year.

Abdul Razak, 46, is charged with abetting them between 9.54am on Oct 18 last year and 9.45pm the following day in the Federal Territory of Kuala Lumpur.

与蒙古女郎炸尸案死者阿旦杜亚一同前来马来西亚的友人乌里杜雅(Uuriintuya Gal Orchir)指出

,尽管她与阿旦杜亚的表妹娜米拉(Namiraa Gerelmaa)曾经力劝阿旦杜亚不要单独重返阿都拉萨的住家

,但是阿旦却坚信说若自己单独赴会,两人必定能够会晤。

这也是乌里杜雅和娜米拉,最后一次见到阿旦杜亚。过后她就在阿都拉萨的住家前宣告失踪。

乌里杜雅是本案的第四证人,她今日在沙亚南高庭上接受马诺兹(Manoj Kurup)副检察司的盘问时表示,在去年10月19日晚上,她与娜米拉先陪同阿旦杜亚前往白沙罗欲会见阿都拉萨不果,不得不折返酒店。过后,阿旦杜亚向两人表示,她要单独乘坐德士,再次到白沙罗去会见阿都拉萨。

“我告诉她不要去,要去就一起去,但是她当时正在操作手机,可能已经接获短讯通知她要单独前去。我要她与我们一起去,但是她却坚持说,若一个人去,就可以见到他(阿都拉萨)。”

“她向我们说“如果我单独去,他就会见我”,她当时非常有信心,认为若一个人去就能够见到他。”

根据本案第一证人,即阿都拉萨聘请的私家侦探巴拉(P Balasubramaniam)上周供证时表示,当晚阿旦杜亚抵达阿都拉萨的住家后仍无法见到阿都拉萨,最后遭三名警察以一辆红色威拉载走。

其中两名警察就是本案的第一被告阿兹拉哈德里(Azilah Hadri)以及第二被告西鲁阿兹哈乌玛(Sirul Azhar Umar),他们被控于当晚10时至第二天凌晨1时谋杀阿旦杜亚。阿都拉萨则被控唆使两人杀死阿旦杜亚。

苏拉斯5次闯入酒店房间

乌里杜雅今日的供证内容与娜米拉大同小异,都指阿都拉萨委派巴拉和其助手苏拉斯(Suras Kumar)恐吓要杀害她们3人。

她在翻译员的协助下表示,苏拉斯曾经闯入她们的酒店房间多达5次,最后一次却遭到酒店的工作人员的阻止,不允许他踏入她们下榻的马来亚酒店。

“我不明白英文,因此我就问阿旦杜亚,(阿旦杜亚告诉我们)她向苏拉斯要求让她见阿都拉萨一次,但是苏拉斯却不断威胁,说阿都拉萨要杀害她,她也不能见阿都拉萨,最好是回去蒙古,不然他将会杀死我们。”

乌里杜雅表示,之后她与阿旦杜亚在10月19日中午前往一间警局针对上述威胁报案,当时她发现苏拉斯骑着摩多在警局外徘徊,“他一看到我就离开”。

她也指称,苏拉斯不断跟踪她们3人,也一直守在马来亚酒店外。

指阿旦来马见“男朋友”

根据巴拉的供词,阿都拉萨是在去年10月雇用他,以阻止阿旦杜亚接近他和保护其家人,并跟踪阿旦杜亚在大马的行踪。

自称认识阿旦杜亚约2至3年的乌里杜雅,在确认阿旦杜亚的照片时,也忍不住流下伤心的眼泪,并以纸巾擦拭泪水。

与早前供证的娜米拉一样,乌里杜雅也表示阿旦杜亚来马的目的,是为了会见“男朋友”。

死者遇害前全身皆名牌货

此外,根据乌里杜雅今日的口供,阿旦杜亚在离开酒店单独欲前往会见阿都拉萨时,全身上下都是名牌衣物与饰品,包括黑色的Spirit外套、深蓝色的Levi’s牛仔裤、黑色的Fendi吊袋,镶有“黑色石头”的耳环、一个看开镶有钻石的戒指,以及一只手表。

马诺兹副检察司今日在法庭上要求乌里杜雅,确认阿旦杜亚在19日晚上失踪前所佩戴的手表时,法庭才发现阿旦杜亚所佩戴的是Larmes的手表。

司机给钱警察协助寻找阿旦

另一方面,法庭今日也出现让人忍俊不住的插曲。当马诺兹要求乌里杜雅确认其中一名在阿旦杜亚失踪后,要求乌里杜雅和娜米拉停止骚扰阿都拉萨住家的警察时,乌里杜雅突然反问马诺兹“你要我在他的面前说话?”让马诺兹也忍不住笑起来说“是的”。

接着乌里杜雅的言论引起哄堂大笑,“我们将钱交给德士司机,司机却当着我们的面前,把钱交给他(警察)”。

在马诺兹进一步的追问下,才发现原来“司机给钱”的一幕并非发生在10月20日乌里杜雅和娜米拉到阿都拉萨住家兴师问罪的那一晚。

乌里杜雅表示,大约是在10月23或24日时,从香港前来大马的阿旦杜亚胞妹布玛(Burmaa Oyunchimeg)把一笔钱交给德士司机,后者当着她们的面前,将钱交给一名警察,以协助寻找失踪的阿旦杜亚。

无论如何,马诺兹并没有追问此事的详情,似乎与案件关系不大。

案件将在明日续审,依然是由马诺兹盘问乌里杜雅,过后才交由辩方律师盘问。

A Mongolian witness told the Shah Alam High Court today that her immigration entry records into Malaysia had been deleted and she was held at the airport for two hours by immigration officers before she could leave the country.On the seventh day of the Altantuya Shaariibuu murder trial, Uuriintuya Gal Ochir, 30, was continuing her testimony before judge Mohd Zaki Yasin who had asked her when she had returned to Mongolia.

Uuriintuya had previously testified that she and a friend, Namiraa Gerelmaa, had accompanied Altantuya to Malaysia on Oct 8 last year.

Uuriintuya told the packed courtroom that while Namiraa had left for Mongolia first on Oct 24, she couldn’t do the same as her passport was with Altantuya on the night the latter went missing.

“On Nov 24, I left with Altantuya’s father Shaariibuu (Setev) but at the airport we had a problem because they (immigration officials) did not have a record of Altantuya, Namiraa or me entering the country. They said they had no data of our records. The entry was deleted in the computer.

“I was still holding my air ticket so they asked me how I came into the country […] was it by sea or by car. So I showed them my ticket that had the date of when I flew into Malaysia.”

Uuriintuya was testifying at the high-profile murder trial of Chief Inspector Azilah Hadri, 30, and Corporal Sirul Azhar Umar, 35, both from the police Special Action Squad, who are charged with murdering translator Altantuya, 28, at a location between lots 12843 and 16735, Mukim Bukit Raja, between 10pm on Oct 19 and 1am on Oct 20 last year.

Political analyst Abdul Razak Baginda, 46, (pix, above left) is charged with abetting them between 9.54am on Oct 18 last year and 9.45pm the following day at Bangunan Getah Asli in Jalan Ampang, Kuala Lumpur. All three accused face the death penalty if convicted.

Expunge request

As Uuriintuya was testifying, both the prosecution and defence teams raised their concerns over the relevance of the her information. However, despite objection by both counsel, she continued with her testimony through a translator.

“There was no record of our entry. At that time (Malaysian honorary consul-general for Mongolia) Syed Abdul Rahman Alhabshi was also following us to Mongolia.

“Two police officers took me (away) saying I came into the country illegally. I was there (at the airport) for two hours before they let me leave,” she said.

At this juncture, Corporal Sirul Azhar Umar’s counsel Kamarul Hisham Kamaruddin requested the court to expunge Uuriintuya’s remarks but was turned down.

“The ruling is that you don’t need to cross-examine her and this will not be expunged. It will remain here (on record),” ruled Justice Zaki.

Following this exchange, Uuriintuya got up and told her translator to tell the judge that ‘she wanted to say something’.

She then proceeded to reiterate to the court that there was no record of the three of them coming to Malaysia via Beijing. “It had been deleted. I wonder why our immigration records for entering Malaysia had been deleted?” 

Diamond ring 

Earlier on, senior counsel Karpal Singh, who is holding a watching brief for Altantuya’s family, asked Uuriintuya, a mother of three, what made her certain that several items she had been asked to identify by the authorities belonged to Altantuya.

“I remember the watch because her (friend) Burmaa (Oyunchimeg) and Altantuya bought it in Hong Kong while the earrings were bought from a shop in Mongolia.

“I think the ring, she told me her boyfriend bought had for her. I believe the boyfriend was (Abdul) Razak (Baginda),” Uuriintuya told the court to gasps of surprise from the gallery.

She added that it was a diamond-studded gold ring.

The trial is expected to run for a month and to hear testimonies from 30 to 40 prosecution witnesses. Hearing continues tomorrow.

Appearing for the prosecution is deputy public prosecutor Tun Majid Tun Hamzah.

A different kind of drama unfolded in the Altantuya murder trial today when prosecution witness Shaariibuu Setev claimed from the witness stand that he was assaulted and harassed by Abdul Razak Baginda’s wife.Shaariibuu, the second prosecution witness, said Mazlina Makhzan (photo) had kicked him this morning.He also claimed that she had also punched him in the stomach as she passed by him during a break this morning.Shaariibuu added that Mazlina had been harassing him since the beginning of the murder trial of his daughter Altantuya.After hearing his complaints, Shah Alam High Court judge Mohd Zaki Md Yasin ordered that the families of Abdul Razak Baginda and Shaariibuu Setev be kept apart.

In tears

Earlier in the day, Shaariibuu became emotional and wept after he was shown his daughter’s photo.

“She is Altantuya”, he said in the Mongolian language. He then took off his spectacles to wipe his tears before his words were interpreted into English.

He also took a swipe at various media reports that had labelled Altantuya as ‘a Mongolian woman”.

He said many people had reported and called her a Mongolian woman “but if you want me to mention her name, I will.”

Justice Mohd Zaki then allowed a 30-minute recess to enable Shaariibuu to calm down before cross-examination by the defence.

The trial will continue after lunch.

炸尸案审讯进入第5天

,继续出现高潮迭起的局面。出席作证的阿旦杜雅父亲沙里布

,今早突然向法庭申诉

,指炸尸案第三被告阿都拉萨巴金达的妻子玛兹琳达(左图),自审讯开始至今就不断骚扰和诅咒他,甚至用脚踢他及殴打其肚子。

在第一被告阿兹拉哈德里(Azilah Hadri)的辩护律师哈兹曼(Hazman Ahmad)在上午结束盘问后,身为第二名证人的沙里布表示欲向法庭做出申诉。

沙里布通过其蒙古翻译员以英语表示,“每次阿都拉萨妻子玛兹琳达经过(我身边),她就踢我。刚才她也打我(沙里布用手指向本身的肚子)。每一次她都压迫、骚扰和诅咒我。我很难忍受。不过,我是一个受过教育的人,我不会对她做出什么行动”。

沙里布补充说,玛兹琳达大约今早10时30分休庭时,在法庭通往证人室的入口处,再一次攻击他。

在听取其投诉后,沙亚南高庭法官法官莫哈末查基即刻下令,把阿都拉萨的家属及沙里布分隔起来。

沙里布:目睹庭警可作证

沙里布(右图)也表示,有庭警目睹他遭到玛兹琳达的攻击。

然而,玛兹琳达在午餐休庭步出法庭时,却怒气冲冲的向记者表示,“我在法庭里踢和殴打他?这有可能吗?简直是撒谎(What a lie)”。

在沙里布申诉完毕后,主控官敦阿都玛吉副检察司(Tun Majid Tun Hamzah)和阿都拉萨辩护律师王健强都站起来,表示对此不知情。

阿都玛吉和王健强表示,两人是在数分钟前,才获得卡巴星告知此事。卡巴星是代表死者家属和蒙古政府的旁听律师。

由于沙里布和玛兹琳达都是此案的证人,因此在每天审讯时,两人都被安排坐在证人室等候。今早在沙里布向法官申诉的时候,玛兹琳达并没有在庭内。

有鉴于此,法官莫哈末查基指示王健强劝请玛兹琳达停止有关行为,而王健强也答应会给予后者劝告。

王健强表示,由于有关事件发生在法庭外,因此与此案无关,只有发生在法庭内才能够构成藐视法庭的罪名。

不过,他补充说,沙里布可以对玛兹琳达采取法律行动,而玛兹琳达也可以自辩,但是皆与此案无关。

敦玛吉表示,他将会与庭警讨论,把阿都拉萨家人与来自蒙古的证人分隔开来。

卡巴星:可视为藐视法庭

此外,卡巴星於中午休庭时告诉记者,“无论是在庭内或庭外,只要是恐吓证人,都可以构成藐视法庭的罪名”。

“这是不对的,你不能伤害证人,无论是通过语言或行动。”

不过,卡巴星继称,沙里布不会采取法律行动。

“没有必要,我们了解被告家属的感受。法庭已经指示辩方律师,此事就告一段落。”

沙里布庭上睹相思女频拭泪较早前,主控官马诺兹(Manoj Kurup)在盘问沙里布时,拿出一张照片,要沙里布确认相中人是否就是其长女阿旦杜雅。沙里布看了相片后悲从中来,并开始流泪。法庭助理於是递给沙里布一盒纸巾,后者频频脱下眼镜,以纸巾拭泪。在旁边的翻译员也拍拍他的肩膀,加以安慰。当时,沙里布表示,“我们蒙古人不会直接讲出死者的名字,但是如果你(主控官)要求的话,我可以告诉你。我们只称死者作‘死者’”。

玛诺表示,“对不起,但是为了法庭记录,请你说出名字。”

这名伤心的爸爸只好说,“阿旦杜雅”。

不久后,法庭就宣布休庭半小时,直到上午11时05分才继续审讯。

去年11月被通知女儿遭谋杀

沙里布在今天的供词透露,阿旦杜雅是与一名亲戚纳米拉(Namiraa Garelmaa)和一名友人乌里杜雅(Uuriintuya Gal Orchir)一起来到大马。

沙里布表示,他是在去年11月初,从蒙古外交部获知阿旦杜雅已遭谋杀。於是,他就在11月9日飞抵吉隆坡。在抵达吉隆坡后,马来西亚警方抽取了他的血液,以进行脱氧核糖核酸测验。

沙里布表示,警方曾告知他,其脱氧核糖核酸与阿旦杜雅的骸骨吻合。

娜米拉是蒙古女郎炸尸案的第三名证人,她通过蒙古翻译员向法庭透露,在失踪之前(2006年10月19日),阿旦杜亚曾与另一名陪同到来马来西亚的友人乌里杜雅(Uuriintuya Gal Orchir),一起前往警局报案。不过,她没有随行,也不知道为何报案。

后来三人在当晚就乘坐德士前往阿都拉萨的住家,并在那里遇见阿都拉萨聘请的私家侦探巴拉(P Balasubramaniam)。不过当后者告诉她们说,阿都拉萨不在家时,她们就折返下榻的马来亚酒店。

单独前去,或能见拉萨

娜米拉说,在大约9时左右,阿旦杜亚向她们表示,“阿都拉萨现在可能人在屋里,我想回去向他说声屠妖节快乐”。

“阿旦杜亚要我们留在酒店里,她认为,如果单独前去,或许可以见到他。”

娜米拉接着表示,在阿旦杜亚乘坐德士离开酒店后,一度致电透露,自己在阿都拉萨的住家之外。过后电话就挂断,自此再也没任何讯息,那是她最后一次与阿旦杜亚说话。

后来,娜米拉和乌里杜雅多次尝试联络阿旦杜亚的手机,却无法接通。她们也试图致电巴拉与其助手苏拉斯(Suras Kumar)以询问阿旦杜亚的下落。不过巴拉却表示不知晓,苏拉斯的电话则无法被接通。

阿旦私家侦探协助报警

第二天,在酒店经理的劝告下,娜米拉在阿旦杜亚之前聘请的私家侦探洪忠明的协助下,前往李孝式路警局报案。

她说,由于自己不会讲英语或马来语,因此在前往报案前,曾致电人在香港的阿旦杜亚胞妹布玛(Burmaa Oyunchimeg,又称艾美Amy,右图),要她以英语告诉洪忠明究竟发生了什么事,过后再由洪忠明与负责报案的警察进行沟通。

这份拥有娜米拉签名的报案书,显示她是报案者,而洪忠明则是翻译员。这份只有4个句长的报案书,是指娜米拉与阿旦杜亚在10月6日抵达吉隆坡。

不过,当翻译员在法庭上将报案书内容念给娜米拉听时,她却表示日期应该是10月8日。

指巴拉致电约往拉萨家

报案书也指一名“印度人”(巴拉,左图)致电阿旦杜亚,指其丈夫阿都拉萨要求这名“印度人”转告她,前往阿都拉萨位于白沙罗的住家。

对此,娜米拉否认。她也否认报案书的另一段内容,即阿旦杜亚与阿都拉萨已成婚。

娜米拉更澄清说,当时她指阿旦杜亚是“姐姐(或妹妹)”,不是报案书上的“女性友人”。

不过,报案书的其他部分都被确认是正确的,即阿旦杜亚离开酒店前往白沙罗后,就失踪,电话也屡拔不通。

临走前留下一张电话名单

娜米拉也表示,阿旦杜亚在19日早上前往警局报案之前,曾交给她一份电话名单,表示若有不测,就联络名单上的电话。

于是她就把电话清单,交给较后抵达的布玛,因为后者会讲英语。

一直到娜米拉返回蒙古后,她才从电视上得悉阿旦杜亚已遭人谋害。

较早前,她也表示,与乌里杜雅一同来马,是为了就读一项语文课程,并不清楚阿旦杜亚来马目的。后者曾表示是要来马,会晤“某人”。

娜米拉表示,自己曾经两次陪同阿旦杜亚到马天然树胶局大厦(Bangunan Lembaga Getah Asli Malaysia)尝试会晤“某人”,但是皆失败。

审讯将在下周一续审,控方将会继续盘问娜米拉。

【本刊曾薛霏撰述】“炸尸案”死者阿尔丹杜雅的表妹纳美拉(Namiraa Gerelmaa)透露,阿尔丹杜雅在去年10月19日下午警察局报案时,曾她和朋友嘉洛琪(Gal-Ochir Uurintuya)留下一份电话名单,并若她出去没有回来,就联络名单上的人。

不过,纳美拉目前手上并没有这份电话名单;她告诉法院,这份名单在布尔玛(Burmaa Oyunchimeg),或别名艾美(Amy,右图)的手上。

纳美拉今日下午回答主控官马诺(Manoj Kurup)盘问时,透露上述情况。在前天(周三)的审讯,主控官阿都马吉(Abdul Majid Tun Hamzah)盘问第一证人巴拉苏巴马廉(Balasubramaniam)时,巴拉透露,阿尔丹杜雅的姐妹艾美发过一则手机短讯恐吓阿都拉萨,而阿都拉萨则短讯转发给巴拉。【点击:证人认出首被告载走死者 阿都拉萨说对凶案不知情】

在雪兰莪莎亚南高等法院开庭的“炸尸案”审讯今天进入第五天,法庭再度传召死者阿尔丹杜雅父亲沙里布(Shaariibuu Setev)和表妹纳美拉供证。纳美拉也是去年10月8日陪同阿尔丹杜雅到马来西亚的两名蒙古女子之一。

阿尔丹杜雅死时28岁,她去年10月来马来西亚后,在1018日至19日期间失踪;116日,她遭炸毁的残骸遗骨在莎亚南丛林被发现。沙里布上周五告诉媒体,阿尔丹杜雅毕业于两所大学,精通六种语文――蒙古语、法语、华语、英语、韩语和俄罗斯语,自四、五年前起就担任专业翻译员,并非本地媒体所说的妓女或模特儿。【点击:举证揭女儿与阿都拉萨关系 沙里布:她不是妓女模特儿】

死者并没见到那个人

主控官问纳美拉是否知道阿尔丹杜雅来马的原因是要见一个人;纳美拉答说,就她所知,阿尔丹杜雅并没有成功见到那个人。她也声称,当时并不知道她要来见什么人。

接下来她说:“现在我知道了。”

马诺问道:“阿尔丹杜雅来见谁?”

纳美拉答道:“拉萨巴金德(Razak Baginda,左图)。”

纳美拉告诉法庭,她们去年10月来马时,入住马来亚酒店。她曾经两次陪同阿尔丹杜雅到第三被告阿都拉萨(Abdul Razak Baginda)的办公室,曾在阿都拉萨的办公室见过巴拉。

纳美拉透露,10月19日当天,阿尔丹杜雅和嘉洛琪曾在下午出去报案,她则独自留在酒店。阿尔丹杜雅外出留下一张电话名单给她和朋友嘉洛琪,并说若她出去没有回来,就联络名单上的人。

不过,纳美拉说,目前手上没有这份电话单,这份名单在布尔玛(Burmaa Oyunchimeg),或别名艾美(Amy)的手上。纳美拉表示,由于艾美英文比较好,她把名单给了艾美,让她联络这些人。

当晚时左右,她们三人同乘德士到阿都拉萨的家抵达目的地时,看见巴拉站在铁门外阿尔丹杜雅问巴拉,阿都拉萨是否在家,巴拉答说不在。

德士司机载她们回到酒店后,阿尔丹杜雅告诉她们,她认为阿都拉萨有可能在家,她要独自去见阿都拉萨,祝贺他“屠妖节快乐”。阿尔丹杜雅认为,她一人去较有可能见到阿都拉萨。虽然嘉洛琪建议她一起去,阿尔丹杜雅拒绝。当时大概是晚上9时30分。

纳美说,“我们回到房间时,阿尔丹杜雅打电话回到酒店她说,她已在阿都拉萨家门外。”当时是纳美拉接听这通电话,不过接下来对方就挂线了。

当晚,纳美拉和嘉洛琪都不停地给阿尔丹杜雅打电话,但一直无法接通当时,酒店一位女经理建议她们次日去报案。

尔后,她们也尝试联络巴拉和其助手苏拉斯(Suras Kumar)前者说不知道阿尔丹杜雅行踪,后者则一直无法联络上。

法院要纳美拉在庭上指认苏拉斯,纳美拉看他时,只是眯着眼睛快速地看了苏拉斯一眼,有点生气地说:“是他。”

报案书与证人当时说法不符

阿尔丹杜雅(右图)晚出去之后,就没有回来,纳美拉担心阿尔丹杜雅的安危而去报警。

10月20日下午,纳美拉和嘉洛琪洪姓私家侦探陪同前往警局报案。由于两人不谙马来语,英语也由洪姓私家侦探协助报案由于艾美的英语流利,所以前往报案之前,纳美拉联络远在香港的艾美。

艾美过后联络洪姓私家侦探协助两人前往报案。当时,由洪姓私家侦探将警员的马来话翻译成英文给两人听,再由私家侦探讲给警员听由于沟通不良,几人报案时还绘图传达报案内容。

主控官马诺问纳美拉,在报案书上签名时是否读过报案书内容?她声称没有人念过内容给她听。主控官后来让通译员协助纳美拉读报案书内容不过,纳美拉随后声称,报案书中有一些话,她并没有说过。她只在报案时,告诉警员她几时来,住在什么地方、阿尔丹杜雅离开后就再没有回来。

于是,主控官马诺便逐句问纳美拉,她是否曾经在警局说过这些话。

马诺:我在2006年10月6日,我的女性朋友阿尔丹杜雅,28岁,住在马来亚酒店,821号房。

纳美拉:我们来的日期是10月8日,我没有说女性朋友,我说姐妹(sister)。

马诺:在2006年10月19日,时间19:00(晚上七时)我的朋友阿尔丹杜雅在马来亚酒店接到一个印男人的电话,说她(阿尔丹杜雅)的丈夫叫他载我的朋友去白沙罗高原。

纳美拉:我从来没有说过这样的话。

马诺:然后,大约20:00(晚上八时),我的朋友联络我她已经抵达他丈夫阿都拉萨巴金德在白沙罗高原的家。

纳美拉:我说她到了那里,其他的我没有说过。

马诺:我的朋友已经跟阿都拉萨巴金德结婚直到现在。

纳美拉:我没有说过。

马诺:直到现在,我联络我的朋友,但是都无法联络上她。

纳美拉:是我的话。

马诺:我报案的原因是,担心有什么事发生在我朋友身上。

纳美拉:我说了这些话,不过没有说朋友,而是说姐妹。

纳美拉说直到离开马来西亚为止,都不知道阿尔丹杜雅发生了什么事。直到后来,她在蒙古看到新闻时,才知道阿尔丹杜雅被残酷地杀死,她被枪杀,然后被炸。

Dr Shaariibuu Setev, the father of the murdered Mongolian national Altantuya today told the Shah Alam High Court that his daughter traveled to Kuala Lumpur last October to meet Abdul Razak Baginda.To a question by DPP Manoj Kurup, Shaariibuu said Altantuya herself told him that.“I asked her if she had anybody as a reason to go there (Kuala Lumpur),” he said.“She told me yes. She said she knows someone in Malaysia whose name is Baginda,” explained Dr. Shaariibuu, with the help of an interpreter.

Shaariibuu is the second prosecution witness to take the stand in this high-profile murder trial.

Private investigator P Balasubramaniam has been testifying for the past three days and almost the full day today. 

Shaariibuu also described his daughter as having a jet-setting life as a professional translator and interpreter.

“She traveled most frequently to Malaysia, Singapore and China, but also traveled to many other countries.”

When asked how many children he had, he replied that he had two daughters.

Manoj will continue with his questioning tomorrow when the trial resumes before Justice Mohd Zaki Md Yasin.

Political analyst Abdul Razak Baginda is charged with abetting the murder of Altantuya. Two special unit policemen, Chief Inspector Azilah Hadri and constable Sirul Azhar Umar are charged with murder.

All three are on trial together and face the death penalty if convicted.

有张笑脸到没有微笑
律师追问下证人供词自相矛盾

【本刊曾薛霏撰述】“炸尸案”控方第一证人巴拉苏巴马廉(Balasubramaniam)今午在法庭继续审讯时,面对第三被告阿都拉萨巴金德(Abdul Razak Baginda)辩护律师王健强的多番盘问,显得有点招架不住,口供出现自相矛盾的地方。尔后,主控官阿都马吉(Abdul Majid Tun Hamzah)再度盘问证人时询问证人是不是第一次出庭供证;证人说是。

轰动国际的“炸尸案”今日进入第四天审讯,法庭今天继续传召控方第一证人巴拉(右图)供证,在审讯进入下午时段,巴拉供证完毕。控方继续传召第二证人沙里布Shaariibbuu Setev)上庭供证。沙里布乃死者阿尔丹杜雅父亲,是本案四位遭到传召的蒙古藉证人之一。

阿都拉萨究竟有没有微笑?

证人的口供出现矛盾的地方主要在于:巴拉向阿都拉萨询问阿尔丹杜雅的行踪时,阿都拉萨微笑要巴拉猜测的部分。王健强表示,证人说第三被告微笑会对被告带来很大的伤害,所以多番盘问要向他厘清,同时也不断在盘问中,加入“你已经宣誓了”、“你最好说真话”、“你同意吗?”之类的话语。

王健强要证人说出,当他在20061020日中午跟第三被告阿都拉萨在其吉隆坡的办公室会面时,当他询问蒙古女子阿尔丹杜雅被扣押在哪间警局时,阿都拉萨是否有微笑?

王健强说:“第三被告在谈论这么重要的事情,不可能微笑。这是很严重的事,关乎人命,第三被告不可能微笑!”

巴拉回答说:“第三被告有一张笑脸。”

王健强再度追问:“让我来告诉你,第三被告并没有如你所说般微笑。你同意吗?”

巴拉沉默了一阵回答道:“同意。”

由于证人的证词,从原本的阿都拉萨(左图)有微笑,转到巴拉说阿都拉萨拥有一张笑脸,再转到巴拉认同阿都拉萨没有微笑,法官开始感到混淆,并且再度要证人说出,到底阿都拉萨有没有微笑?

在这段期间,法庭中开始有人窃窃私语,巴拉本身也因为这个混淆弄得微笑起来,不过法官马上严厉指令巴拉不要笑,因为此案件事关重大,巴拉的笑脸随即消失。过后,他回答道:“第三被告一面微笑一面要我猜。”

巴拉在周二供证时,告诉法庭阿尔丹杜雅在20061019日被第一被告带走之后,第二天跟阿都拉萨会面时,询问他,阿尔丹杜雅被扣押在哪里,阿都拉萨微笑说出三个地点要他猜,旋即又告诉巴拉,他自己也不知道。【点击:阿都拉萨告诉证人召警抓人 翌日答说不知死者扣押何处】

巴拉今日也告诉法庭,他在111日之前并不知道阿尔丹杜雅被谋杀的消息。他在阿尔丹杜雅被带走之后一直到111日之间,都一直认为阿尔丹杜雅遭到逮捕和扣押。

苏拉斯与蒙古女子有亲密关系

炸尸案”在下午续审的时候,出现了“小高潮”。使法庭昏昏欲睡的公众和媒体清醒过来的“小高潮”出现在王健强盘问证人“是否知道其助手苏拉斯(Suras Kumar)跟三名蒙古女子过过于亲密,而苏拉斯曾跟其中一名蒙古女子在酒店过了一夜?”的时候。

王健强盘问巴拉,第三被告是否曾向他投诉过苏拉斯跟三名蒙古女子的关系亲密?巴拉答有。他进一步问,巴拉是否因为这个阿都拉萨的投诉,而在18日终止苏拉斯的服务?巴拉承认是。王健强问巴拉是否同意苏拉斯跟蒙古女子的关系违反私家侦探的职业操守,巴拉认同。

当王健强进一步盘问他,是否有告诉第三被告,苏拉斯跟三名蒙古女子包括阿尔丹杜雅之中的一位有不可告人的关系(hubungan sulit)?证人不同意。

王健强继续问道:“你是否同意,苏拉斯跟三名蒙古女子的亲密关系导致他在18日被解雇?亲密关系的意思是什么?”

巴拉回答:“我停止苏拉斯的服务是受到第三被告的指示。”

王健强再问:“我只是要问你亲密关系是什么意思?”

巴拉再度重申:“我停止苏拉斯的服务是受到第三被告的指示。”

王健强把问题修改了一下,再问道:“之前是否有任何一个顾客,曾经要求你解雇你的雇员?”

巴拉答:“没有。”

王健强继续说:“我告诉你,第三被告从来没有指示你停掉苏拉斯和另外两名雇员。你同意吗?”

巴拉说:“我不同意。”

王健强再问:“你知道苏拉斯在马来亚酒店订了一间房。同意吗?”

巴拉:“不同意。”

王健强:“我告诉你,巴拉,苏拉斯曾经跟其中三位蒙古女子,包括阿尔丹杜雅中的一位蒙古女子过了一夜,你知道吗?”

巴拉:“不知道。”

当巴拉回答到这里,法官也禁不住问王健强,究竟苏拉斯是跟哪一个蒙古女子,共度一夜,王健强坦言本身也不知道。

法庭今日传召沙里布(左图)为控方第二证人。他在出庭供证时表示,其女儿阿尔丹杜雅告诉在最后一次来马来西亚之前曾经告诉他,她在这里认识了一个人,他的名字叫巴金德(I met a guy, and his name is Baginda.)。

无论如何,后来通译员恩佳尔伽(Enkhjargal Tsetsgee)在重复沙里布的话时,将句子改成:“她有一个重要人物,他的名字叫巴金德”(She has somebody, and his name is Baginda)。

沙里布于上周六(616日)召开记者招待会时,非常肯定地告诉媒体,阿都拉萨和阿尔丹杜雅从未有爱情关系,也从未结过婚。他也再三重申,他的女儿是一名翻译员,并非如早前媒体所报道般,是一名模特儿,更不是一名妓女。【点击:举证揭女儿与阿都拉萨关系 沙里布:她不是妓女模特儿】

沙里布于今日下午,控方第一证人巴拉(Balasubramaniam)供证完毕后,遭传召为证人。他在整个审讯过程中的证词都由恩佳尔伽充当其通译员。

通译员身份惹争议

在法庭接受恩佳尔伽的通译服务之前,第二被告辩护律师再迪(Zaidi Zainal)提出,恩佳尔伽曾经多次陪同沙里布出席记者招待会,由于法庭内没有人听得懂蒙古话,而担心通译员会偏袒。他坦言自己并不是反对,只是希望法官关注此事。不过,第一被告辩护律师因为下午才进来,声称不了解此事;第三被告辩护律师王健强则说:“只要继续审讯,我不反对”。

家属旁听律师也向法官解释,这名通译员是蒙古参赞代表法庭指派的。当时,法官问法庭内是否还有其他人懂得蒙古话,不过并没有人回应。当时曾经在记者招待会上,充当沙里布的翻译员的蒙古国家法律中心研究员巴雅(Bayar Purevdorj)也在法庭内,不过他并没有回应法官的提问。

尔后,法官接受了恩佳尔伽为沙里布的通译员。

询问阿尔丹杜雅来马原因

沙里布也告诉法庭,其长女阿尔丹杜雅未曾结婚,跟两名小孩一起住,以翻译工作为生。

主控官马诺(Manoj Kurup)盘问控方第二位证人沙里布,其女阿尔丹杜雅最后一次来马来西亚时有否有告知他,那时候是几时?沙里布回答说,阿尔丹杜雅在来马前曾致电给他,告诉他,她要来马的消息。沙里布要求女儿,在离开之前见他一面。不过,他并不确定那时候是2006107日或8日。

马诺再问沙里布,两人会面时,他是否询问过阿尔丹杜雅(左图)来马来西亚的原因。

沙里布叙述,他当时询问阿尔丹杜雅:“为什么如此喜欢马来西亚,为什么一直要去哪里?你已经去马来西亚两次了,为什么?你在那里是不是有认识的人?”

沙里布说,阿尔丹杜雅说是。沙里布再进一步问两人的关系。阿尔丹杜雅告诉沙里布,她在这里认识了一个人,他的名字叫巴金德(I met a guy, and his name is Baginda.

不过后来通译员恩佳尔伽在重复沙里布的话时将句子改成:“她有一个重要人物,他的名字叫巴金德”(She has somebody, and his name is Baginda)。

法庭就在此时决定休庭,预计主控官明日会继续盘问沙里布。

【本刊曾薛霏撰述】“炸尸案”今午续审时,第二被告辩护律师卡玛鲁希(Kamarul Hisham)挑出控方第一证人巴拉苏巴玛廉(Balasubramaniam)口供不一致,即巴拉第二次阿都拉萨会面时(年10月6日或7日),并不知道阿都拉萨是否要接受巴拉的服务;但是巴拉在聆讯第一天(18日)却已告诉法庭,阿都拉萨第二次他会面时,就已说明他的任务是阻止一名蒙古女子接近他。

卡玛鲁在盘问过程中,多次指巴拉的供证“不正确”(tidak tepat)。

此外,巴拉(右图)回答第一被告辩护律师哈兹曼(Hazman Ahmad)盘问时透露,他警方拘留两次,以协助查案;一次是恐吓案,另一次则是谋杀案。

“炸尸案”今日进入第三审讯,主控官、第一被告辩护律师第二被告辩护律师相继盘问第一证人巴拉。主控官阿都马吉也向法庭提呈数位案中人的来往电话和手机简讯资料,当作呈堂证物。

主控官阿都马吉也点出一些巴拉和第三被告阿都拉萨于2006年10月19日和20日之间来往电话和简讯的时间,盘问证人关于两人所谈论的话题。主控官的盘问,主要是以这些资料更详细地点出双方通讯的时间。

巴拉口供不一致

第二被告西鲁阿兹哈乌玛(Sirul Azhar Umar辩护律师卡玛鲁从巴拉宣称关自己第二次第三被告阿都拉萨巴金德会面时,不晓得阿都拉萨要他执行什么任务这个部分切入,找出巴拉口供不一致之处。

巴拉是在本案第一天(18日)聆讯时告知法庭,一位名叫马根(Magen)的人致电给他,要介绍客户给他,并叫他到吉隆坡天然橡胶大楼10楼办公室,他也是在那时第一次阿都拉萨会面。

后,阿都拉萨致电给巴拉,要他跟其家庭律师迪仁(Dhiren Rene Norendra)商讨服务收费。巴拉迪仁会面时,告知迪仁他的收费为每天马币800元,或以20天收费马币七千元配套,两人最终同意巴拉整个服务的收费为马币四千元。

巴拉前供证时也表示,阿都拉萨在他们第二次会面时,他一名蒙古女子骚扰,而巴拉的任务就是要阻止这名女子与他会面。不过,当天主控官阿都马吉询问他是否知道阿都拉萨需要他的服务,他答说不知道。

卡玛鲁今午盘问巴拉:“第三被告要你其家庭律师会面商讨服务收费时,你是否已经知道自己的任务。”巴拉回答说不知道。

卡玛鲁再度询问巴拉是家庭律师还是第三被告告知他的任务,巴拉回答说是第三被告阿都拉萨告诉他。卡玛鲁也进一步盘问,巴拉是否确定自己并不知道阿都拉萨是否要他提供服务。

巴拉说是。

卡玛鲁说道:“当你告诉法庭,那么多有关第二次会面之前,你接到迪仁的电话,商讨服务收费事宜,而你也告诉迪仁你的收费。你也说是第三被告告知你的任务,但是你还是要坚持说你在第二次会面时并不知道第三被告要你的服务?不要换了?”

巴拉重申:“我不知道第三被告是否要我的服务。”

尔后,法官则说道:“服务收费是谈了,成不成还不知道。”

巴拉:我猜蒙古女子是来恐吓

接着,卡玛鲁问巴拉,他于年10月9日当天接到第三被告的电话,说有三名蒙古女子在去后者位于吉隆坡办公室的事。

根据巴拉周一的供证,他于10月9日接到阿都拉萨(左图)的电话,告知他有三名蒙古女子和一名男子在其办公室,并要巴拉去解决这件事。巴拉要助手苏拉斯(Sulas Kumar)先骑电单车去,他随后才到。他去到大厦10楼时,接待员告诉他,三名蒙古女子在阿都拉萨办公室门缝下塞了一封信。然后,便升降机下楼。

他也,他下楼后看见三名蒙古女在大厦楼梯他观察们的举动,并劝告阿都拉萨报警,后者并没有采取任何行动。

巴拉当天供证时说道:“我猜蒙古女子是来恐吓阿都拉萨。”

卡玛鲁盘问巴拉道:“接待员没有告诉你这三名蒙古女子的行为举止?”

巴拉答说:“没有。”

卡玛鲁说:“你看她们的样子,站在外面看着建筑物,她们也没有任何挑衅的动作,对吗?”

巴拉答道:“她们没有做任何构成恐吓的事。”

不过,当时巴拉却报了警。他担心着三名女子再度回到10楼,干扰10楼的办公室,因为是他受命看管的办公室。

卡玛鲁随即说道:“他们只是留下一封信,你就报警?”

巴拉答道:“如果我不报警,这三名女子可能会再回到10楼骚扰,这是我报警的原因。我当时并没有想到恐吓的事情。”

卡玛鲁此时指出:“你在法庭上供证说:我去观察她们,我猜她们是来恐吓第三被告吗?”

他再度说出之前的供词:“我进到大堂,看到三名我猜是蒙古的女子进来大厦的铁门。我注意着她们,我猜她们是要来恐吓第三被告。”

由于已接近休庭时间,卡玛鲁估计会在明日继续盘问控方第一证人。

巴拉曾遭警察拘留助查案

第一被告辩护律师哈兹曼今日下午盘问巴拉,在11月1日到吉隆坡警察总部认人后,否遭警方逮捕巴拉回答说没有。辩护律师进一步盘问巴拉是否曾遭警方拘留协助调查,他回答自己曾被拘留两次;虽然不记得是几时,却很肯定在认人过程之后,才遭警方拘留。

哈兹曼再追问证人,警方是否曾经告诉他遭拘留的原因,他回答道,第一次遭拘留警方告诉他恐吓案有关,第二次没有说什么原因,只是告诉他是《刑事法典》第302条,即谋杀案有关。

巴拉今早回答主控官阿都马吉Abdul Majid Tun Hamzah盘问时告诉法庭,他在11月1日受召到吉隆坡警察总部认人时,才知道蒙古女郎阿尔丹杜雅(右图)被杀的消息。当时在警局接待他的警员是颜姓警官(音译,DSP Gan)告诉他有一宗谋杀案,需要他去认人。

A Mongolian woman demanded half a million dollars from her ex-lover two days before she was murdered, a court was told today.Altantuya Shaariibuu, 28, made the demand after causing a commotion outside the home of Abdul Razak Baginda, 47, who is charged with abetting her murder, a private investigator told the trial of Abdul Razak and two police officers.Prosecutors say that Abdul Razak planned Altantuya’s murder and ordered the two police officers – members of a special unit charged with protecting the country’s leaders – to carry it out.The woman was killed by “probable blast-related” injuries in Shah Alam district southwest of the capital Kuala Lumpur, prosecutors say.Abdul Razak, a political analyst, has vehemently denied any involvement.

All three defendants face the death penalty if convicted.

Causing a commotion

Private investigator P Balasubramaniam, the first prosecution witness called to testify, told the court this morning that Abdul Razak had hired him for RM4,000 to keep Altantuya away from him.

On the opening day of the trial on Monday, prosecutors alleged that Abdul Razak and Altantuya met in 2004 and had a relationship, during which he gave her money.

After they broke up in 2005, he allegedly continued to give her money whenever she demanded. The payments stopped last year, which angered her and prompted her to travel to Malaysia in October, the prosecution said.

Balasubramaniam testified that he began working for Abdul Razak on Oct 13 or 14 last year.

About two days into the job, he saw Altantuya and two other women briefly stop outside Abdul Razak’s home in a taxi, he said.

On Oct 17, he testified, he went to Abdul Razak’s home after he called and said the woman – whom he knew by the name “Aminah” – was outside.

“Aminah was causing a commotion and shouting and she said, ‘Razak, bastard, you come out! I want to speak to you,” the investigator said. Abdul Razak did not emerge from the home.

The investigator said Altantuya had her own private eye, Ang Chong Beng, who was sitting in a car observing the incident.

He said he called police, and a patrol car took him and Altantuya to a police station. She was not arrested, but wanted to file a police report, he said.

“Ang advised her against it. He told her he would talk to me about whatever she wanted from Razak,” Balasubramaniam said.

Money and tickets

At the police station she also told Balasubramaniam she wanted a large amount of money and air tickets to Mongolia, he said.

“Aminah had demanded 500,000 US dollars and three air tickets to Mongolia,” he said.

The investigator did not state why she made the demand but earlier testified Abdul Razak hired him “because the woman has been harassing him for money.”

Balasubramaniam said he called Abdul Razak’s lawyer that night and asked them to file a police report but they declined.

Balasubramaniam told Abdul Razak of her demands the next morning.

“He told me he would discuss with senior police officials that he knew before deciding on the next move,” the investigator testified.

Prosecutors allege that the next day, when Altantuya returned to Abdul Razak’s house, he called police. The two accused officers allegedly took her away, never to be seen alive again.

The first prosecution witness told the Shah Alam High Court today that he was present when Mongolian national Altantuya Shaariibuu was taken away by police personnel in a red Proton Wira on Oct 19 last year.

Private investigator P Bala Subramaniam who was employed by political analyst Abdul Razak Baginda said he went to Razak’s residence in Bukit Damansara, Kuala Lumpur, that night.

Altantunya arrived in a taxi alone later.

Bala then contacted Razak and was told that the police are coming to arrest her. He was also instructed to wait and talk to Altantuya until the police arrive.

“She approached me and started telling me about her ‘sad stories’,” he said.

“She told me that her father had died and her mother is suffering from cancer (both claims are not true). She also said that her brother had gambled his apartment in Mongolia away and was now forcing her to ask money from Razak,” he added.  

It was after this that a red Proton Wira showed up but Bala did not tell her they were police personnel, to prevent her from fleeing. However, he later told her that the police personnel were arresting her.

According to him, she sat in the car voluntarily and was taken away by three police personnel, including a woman.

Bala said he met Razak the next day and quizzed him as to where Altantuya was. “Razak smiled and said ‘I don’t know where Altantuya is kept because the police who arrested her did not tell me.’

“He then wished me ‘Happy Deepavali’ and paid me RM2,000 for my services,” added the private investigator.

Bala also said that he suggested to Razak three possibilities where Altantuya may be kept – the Travers police station, the Special Branch lock-up in Jalan Ipoh and another location, which he could not recall.

Caused a commotion 

On another occasion, he said Altantunya showed up at Razak’s house and caused a commotion. She yelled, “Razak, bastard, you come out! I want to speak to you!”

After her disappearance, Bala said two of her Mongolian companions identified as Namiraa Gerelmaa and Uuriintuya Gal Orchir arrived at Razak’s residence on Oct 20 last year with Ang Chong Beng, the private investigator hired by Altantunya.

“They claimed that Altantuya was being held captive in Razak’s house, asked for her release and said they would return to Mongolia,” Bala related.

However, the situation was defused after the police showed up and everybody left the scene soon after.

Prior to this incident, Altantuya had visited Razak’s residence and office several times.

One time, she allegedly followed the police to the Brickfields police station where she revealed to Bala her demands for US$500,000 and three flight tickets back to Mongolia.

Text messages 

It was at this time that Bala met Ang after he had related her claims to the analyst.

Bala then told Razak that he feared for his safety and the safety of his staff because he was worried that Ang would harm them. He also expressed his intention to quit for this reason.

“Razak told me he would contact top police officials that he knew to take the appropriate action,” he said.

Bala was also made to read out text messages between him and Razak, but it was mostly inaudible to the public gallery as he read it out softly.

However, public prosecutor Tun Majid Tun Hamzah pointed out one that read: “A lies too much. The taximan is another victim” and asked Bala to identify who “A” was.

Bala then replied “A” was Altantuya.

In another instance, Bala revealed that he had followed Razak and the analyst’s father Abdullah Malim Baginda to lodge a police report at the Brickfields police station but Bala claimed that he did not know the contents of the report.

Razak, is charged with abetting the murder of Altantuya, 28, between 10pm on Oct 19 and 1am on Oct 20 last year. Her body was blown up in a jungle clearing in Shah Alam, Selangor.
Two police officers, Azilah Hadri, 30, and Sirul Azhar Umar, 35, are charged with the murder. They are members of a special unit that guards top Malaysian leaders, including the prime minister and his deputy.

All three accused face the death penalty if convicted.

The high profile trial is expected to run for a month and to hear testimony from 30 to 40 prosecution witnesses.

The hearing continues tomorrow.

【本刊曾薛霏撰述】“炸尸案”控方第一证人巴拉苏巴玛廉(Bala Subramaniam)今天下午供证时透露死者阿尔丹杜雅是在去年10月19日晚上11时过后被警察带走警察到来之前,第三被告阿都拉萨巴金德(Abdul Razak Baginda)告诉巴拉,他已通知警察逮捕阿尔丹杜雅,并要证人拖延她。

不过,巴拉在第二天询问阿都拉萨,阿尔丹杜雅被扣押在哪间警察局,阿都拉萨却笑说自己也不知道。

另外,巴拉也告诉法庭,当阿尔丹杜雅知道开着红色普腾国产车来到阿都拉萨家门的警察是要逮捕时,便自行走到车子后座坐下,过后被载走。

“炸尸案”今在雪州莎亚南高等法院展开第二天审讯。今天,控方再度传召第一证人巴拉出庭供证巴拉是受聘于阿都拉萨,以保护其家人免受阿尔丹杜雅骚扰的私家侦探。巴拉2006年10月9日开始阿都拉萨工作助手苏拉斯(Suras Kumar)分别驻守在阿都拉萨住家和办公室。

巴拉宣称,就他所知,在他阿都拉萨工作期间,阿尔丹杜雅并没有成功见阿都拉萨他认为,他的工作算成功。阿尔丹杜雅在2006年10月8日两名朋友来马,多次希望会见阿都拉萨都不成功

遭红色普腾英雄载走

巴拉今接受主控官阿都马吉Abdul Majid Tun Hamzah盘问时告诉法庭他是在去年11月19日晚上时左右接到阿都拉萨的电话,告知他要外出开斋,并指示巴拉,若阿尔丹杜雅出现在其府邸就发短讯通知他。

晚7时20分,阿尔丹杜雅两名女性朋友乘德士经过阿都拉萨家,德士并没有停在门口。半小时后,阿尔丹杜雅再次单独乘德士来到阿都拉萨府邸,德士停在距离屋子公尺外;然后,阿尔丹杜雅下车朝巴拉走来。

看到阿尔丹杜雅(右图)之后,巴拉即通知阿都拉萨,阿都拉萨要他拖延阿尔丹杜雅,并称警察会前去捉人。就在巴拉拖延阿尔丹杜雅期间,后者叙述了自己的悲惨故事。

巴拉忆述阿尔丹杜雅的故事时说道:“她告诉我,她的父亲过世了,母亲患癌在医院留医;哥哥因赌博输掉他们在蒙古的公寓,还逼她来马向阿都拉萨要钱。她还说,她甚至没钱支付马来亚酒店的房钱。”

过后,警察开着一辆红色普腾英雄(Wira)来了,一名男子下了车,手指着阿尔丹杜雅,询问巴拉:“就是这个女人么?”

巴拉,这名警察随后回车上打电话。阿尔丹杜雅问巴拉,这男子是谁?巴拉骗她说那是阿都拉萨的亲戚。一辆蓝色的国产花蝴蝶(Iswara)汽车经过,司机望向巴拉,然后又开走。适才的警员再度下车告诉巴拉,他要带阿尔丹杜雅巴拉这时才告诉阿尔丹杜雅,这名男子是警察。

阿尔丹杜雅听后,自行走向辆车,坐在汽车后座。车里还有一男一女,女子原本坐在前座,尔后跟坐在后座的男子换位。车子接着就载走了阿尔丹杜雅,但巴拉没有认清那一男一女的样貌。

巴拉后来告知阿都拉萨,阿尔丹杜雅被带走的事,对方只说“好(OK)”。

阿都拉萨说不知道死者被扣押在哪里

10月20日,巴拉下午时至时之间到阿都拉萨位于吉隆坡的办公室见他,询及阿尔丹杜雅被扣押在哪间警察局。阿都拉萨提出三个地点要巴拉猜,不过随即笑说,他本身也不知道。阿都拉萨提的三个地点是Travers路警察局、怡保路政治部扣留所,另一个地点,巴拉声称忘了。

巴拉在19日当天值班至20日早上,过后离开阿都拉萨府邸回家睡觉,他相信在这段期间,阿尔丹杜雅其中一个英语较好的朋友曾联络他,问他阿尔丹杜雅的行踪。他告诉她们阿尔丹杜雅被警方逮捕了。

当天晚上11之后,阿都拉萨致电告诉巴拉,其家门外有两名女子和一名男子在吵闹,要他前来解决此事。在前往阿都拉萨家途中,巴拉已致电给警方当他抵达阿都拉萨家时,看见阿尔丹杜雅的两名女友及阿尔丹杜雅雇用的洪姓私家侦探在门外。

他们大声说阿尔丹杜雅被禁锢在阿都拉萨的家内;她们阿都拉萨释放阿尔丹杜雅,承诺会把阿尔丹杜雅带回蒙古。

警察巡逻车抵达后,又有另一名探员前来因为洪姓私家侦探当天阿尔丹杜雅失踪报案。这位名为费洙(Mohd Faizul)的探员,是来调查阿尔丹杜雅失踪。巴拉告诉费洙,阿尔丹杜雅不在屋内,因为她已在19日遭警方逮捕。

尔后,一名警官致电巴拉,并要求费洙对谈不过,巴拉不知道他们谈什么。过后,费洙洪姓私家侦探说了一些话,所有人便离开阿都拉萨的屋前。

巴拉表示,他是在1022日或23日时再度阿都拉萨碰面,他们相约在白沙罗镇(Pusat Bandar Damansara)的星巴克咖啡馆见面阿都拉萨要巴拉陪同他去吉隆坡十五碑警局报案,但阿都拉萨没告诉巴拉为什么事报案。当时,阿都拉萨的父亲也在场。

来往电话和短讯资料当证据

主控官阿都马吉今也提呈巴拉手机电话和短讯通联记录当证据,通联记录显示他和阿都拉萨来往的短讯和电话,以及一个巴拉觉得“可能”是阿尔丹杜雅电话的号码。

在10月20日凌晨12左右,阿都拉萨发了一短讯给巴拉指:“A说了太多谎。”

主控官继续询问巴拉,阿都拉萨所指的“A”是谁巴拉回答说,“A是指阿尔丹杜雅。”

由于时间已至下午5时10分,主控官要求休庭;法官较后宣布,案明日早上9时15分再审。

Yes, before Malaysians have a chance to hear more about the case, it has been postponed to another two weeks.

What an anti-climax! And it’s so unfair to Shariibuu’s family who flew in all the way from Mongolia. First they lost lost their child to Malaysian murderer and killers. And now they were treated with postponement without any justification! Why the last minute change of prosecution team? What’s wrong with the original team? 

Who were ‘uneasy’ or ‘uncomfortable’ with the original team?

Do not forget that the courts have earlier changed the judge and replaced with relatively junior one without any justification!

Lawyer alleges interference in murder case

The lawyer for a senior policeman on trial for murdering a Mongolian woman withdrew on Monday and alleged interference in the case.Zulkifli Noordin said he could no longer act in defence of Chief Inspector Azilah Hadri.Zulkifli told reporters he believes fully in his client’s innocence but “certain facts have come to my attention during my preparation of the trial” that would compromise his ability to act further.”There were serious attempts by third parties to interfere with the defence that I proposed,” he said, declining to elaborate.Azilah and another police officer, Sirul Azhar Umar, 35, are charged with the murder of Altantuya Shaariibuu, 28.

Altantuya was the lover of Abdul Razak Baginda, a political analyst with close ties to Deputy Prime Minister and Defence Minister Najib Abdul Razak, who has vehemently denied any involvement in the case.

All three accused face the death penalty if convicted.

The trial began today but was immediately postponed for two weeks until June 18 after prosecutors said they had only been assigned to the case on Sunday.

Prime Minister Abdullah Ahmad Badawi has pledged there will be no cover-up.

Jet-setting romance

Abdul Razak, a British-educated political and defence analyst who heads the Malaysian Strategic Research Centre, a think tank, was introduced to Altantuya in Hong Kong at the end of 2004, he said in an affidavit and statements to police.

She was a trained teacher and a translator who spoke English, Russian and Chinese, her father has said.

The couple conducted a jet-setting romance, meeting in Hong Kong, Shanghai, Singapore, Kuala Lumpur and France. Abdul Razak said they broke up around August 2005.

She was killed last October and her body blown up in a jungle clearing in Shah Alam district southwest of Kuala Lumpur.

Abdul Razak, wearing a blue business-style shirt and dark pants, shed tears along with his mother as they hugged after he entered the courtroom.

He also embraced his teenage daughter before proceedings began, watched also by his parents and a brother.

“Pray for his innocence,” Abdul Razak’s wife, Mazlinda Makhzan, told AFP after her husband arrived in a white van chased by a pack of about 20 news photographers.

He was expressionless and did not answer questions as he was led into the court building.

Integrity under scrutiny

Altantuya’s father Shaariibuu Setev, 55, also declined comment when he arrived.

As court proceedings began, Najib, the deputy prime minister, opened a global tourism conference in Kuala Lumpur. He declined to comment on the trial.

Ramon Navaratnam, head of Transparency International Malaysia, a branch of the anti-corruption watchdog, said the world would be watching the trial.

“No one can afford to see the case being mishandled or interfered with,” he said, “because the whole integrity of the judicial system is under scrutiny.”

The Altantuya Shaariibuu murder trial which was scheduled to begin today has been postponed to June 18 following an application by the prosecution in the Shah Alam High Court this morning. Judge Mohd Zaki Md Yasin allowed the high-profile murder case to be adjourned after the court was told that a new team of prosecutors had taken over the handling of the case on a short notice and that they needed more time to study it.”Taking into account that there are foreign witnesses present, I will grant an adjournment of only two weeks. Trial will start on the 18th of June,” Mohd Zaki told a packed courtroom.Lead prosecutor Tun Majid Tun Hamzah had asked for one month to prepare for the trial after “a sudden twist of events”.

“I was only informed to take over this case yesterday in the evening when I was on my way home. It’s beyond me. I simply cannot prosecute this case at such short notice,” the senior prosecutor told the court.

“I have more than 100 statements and investigation papers to go through. It is only right to allow us to conduct the prosecution well.”

Karpal Singh who was holding a watching brief for Altantuya’s family then argued that the cost of the month-long visit to Malaysia by the three Mongolian witnesses and two interpreters was being paid with taxpayers’ money.

“A one month postponement would be unreasonable. I suggest two weeks and not more,” he said.

He also demanded an explanation as to why the prosecution team was changed overnight.

Tun Majid replied: “I am not privy to that information” before issuing apologies to the defence lawyers and Altantuya’s family members.

Meanwhile, Karpal made an application for one of the defence lawyers to be disqualified because he has family relations with the judge.

“Counsel Hazman Ahmad’s late wife was the niece of Mohd Zaki. Justice must not only be done but must seen to be done. He must be disqualified,” he said.

Hazman who is representing Chief Inspector Azilah Hadri said that while the facts are true it does not mean that the trial will be conducted unfairly.

After deliberating for several minutes, Mohd Zaki dismissed Karpal’s application.

Packed courtroom

Lawyer Wong Kian Kheong applied for a discharge not amounting to an acquittal or bail in the alternative for his client, political analyst Abdul Razak Baginda.

“By virtue of the fact that the prosecution is not ready, my client should at least receive a discharge not amounting to acquittal or released on bail. He’s not going to run away,” he said before Mohd Zaki allowed the court to stand down.

Twenty minutes later, Mohd Zaki returned and dismissed Wong’s application and set June 18 with a two-month extension if necessary for the trial to be heard. He adjourned the proceedings soon after.

The courtroom which could accommodate about 60 people, was filled an hour before the proceedings began. There were over 100 people, with some 30 standing. Extra benches were being brought in amidst a commotion outside when the three accused entered the courtroom.

As the handcuffs were taken off Razak, he embraced his wife Mazlinda Makhzan and daughter Rowina before the trial started. His family sat close by while he took a seat in the dock alongside the other two accused.

Charged with the murder are policemen Azilah Hadri, 31, and Corporal Sirul Azhar Umar, 36, for allegedly committing the murder in Mukim Bukit Raja, Selangor, between 10pm on Oct 19 and 1am on Oct 20 last year.

Razak, 47, is accused of abetting the two special action force personnel, allegedly committing the offence at the Bangunan Getah Asli in Jalan Ampang, Kuala Lumpur, between 9.54am and 11.05am on Oct 18 last year.

If convicted, all three face the death penalty.

The case has gained international prominence due to the personalities involved – Abdul Razak is a known associate of Deputy Prime Minister Najib Abdul Razak.

Altantuya’s family – her father and three cousins are here as prosecution witnesses – also filed RM100 million civil suit this morning against the Malaysian government and the three defendants.
